By accessing or using Chatonbo (“the Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service. These Terms apply to all users, including visitors, registered users, and clients.

2. Description of Service

Chatonbo is an AI-powered chatbot platform that allows businesses to create, train, and deploy intelligent chatbots on their websites. The Service includes a web dashboard, embeddable widget, API access (on paid plans), and supporting infrastructure.

3. Account Registration

To use Chatonbo, you must create an account and provide accurate, complete, and current information. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activity that occurs under your account
• Promptly notifying us of any unauthorized access to your account
• Ensuring all team members comply with these Terms

4. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe the intellectual property rights of others
• Transmit spam, malware, or other harmful content
• Impersonate any person or entity
• Attempt to gain unauthorized access to our systems
• Use the Service to build a competing product or service
• Scrape, crawl, or extract data from the Service without permission
• Deploy chatbots that deceive, harass, or harm end users

5. Plans, Billing, and Payments

Chatonbo offers Free, Pro, Business, and Enterprise plans. Paid plans are billed in USD on a monthly or annual basis.

• Prices are subject to change with 30 days notice to existing subscribers
• Paid plans are non-refundable except as required by applicable law
• Failure to pay may result in suspension or termination of your account
• You may cancel your subscription at any time; your plan remains active until the end of the billing period
• Downgrading your plan may result in loss of access to features and data above the new plan limits

6. Intellectual Property

Chatonbo and its content, features, and functionality are owned by us and are protected by copyright, trademark, and other intellectual property laws. You retain ownership of the content you upload to the Service (knowledge base documents, bot configurations, etc.), and you grant us a limited license to use that content solely to provide the Service.

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms. By using Chatonbo, you agree to the collection and processing of data as described in our Privacy Policy.

8. AI and Third-Party Services

The AI capabilities of Chatonbo are powered by OpenAI. By using the Service, you acknowledge that your content may be processed by OpenAI in accordance with their usage policies. We are not responsible for the accuracy, completeness, or appropriateness of AI-generated responses. You are responsible for reviewing and validating the content your chatbot delivers to end users.

9. Limitation of Liability

To the maximum extent permitted by law, Chatonbo shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, revenue, or profits. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.

10. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind. We do not warrant that the Service will be uninterrupted, error-free, or meet your specific requirements. Use of the Service is at your own risk.

11. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for violation of these Terms or for any other reason at our sole discretion. You may terminate your account at any time via the account settings in your dashboard. Upon termination, your data will be retained for 30 days before permanent deletion.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or via a prominent notice on the platform at least 14 days before changes take effect. Continued use of the Service after changes constitutes acceptance of the new Terms.
